Massachussets, WSET, and Grape Experience

The Wine & Spirit Education Trust offers its programs in Massachusetts, in conjunction with Adam Chase (adam@grapeexperience.com) and his company Grape Experience.

Mr. Chase uses the following disclaimer with the WSET programs offered in Boston:

"WSET qualifications are part of the UK qualifications framework, and the education courses leading to WSET qualifications are an invaluable source of information for students to enhance their knowledge of wines and spirits. WSET qualifications are not a guarantee of employment or career progression, nor do they form part of any regulated qualifications framework outside UK."

However, he does claim that the programs are designed for industry professionals in other parts of his website and advertising materials.. The disclaimer does not go far enough, since it does not state that the certifications are only legal withing the UK.

Whether or not there is a disclaimer, the WSET programs are still illegal under Massachussets state law.

603 CMR 3.00:
Private Occupational Schools

School. A private business school as defined by M.G.L. c. 75D, § 1, a private trade school as defined by M.G.L. c. 93, § 21A, or correspondence school as defined by M.G.L. c. 75C, § 1. This term does not include seminars.
Seminar. Short term training of no more than 15 hours duration, not scheduled in a regular calendar format, and offered as introduction or orientation to an occupation or as advanced level training to those already engaged in a business or trade.
 

Since the WSET has not applied to become a school according to the laws of massachusetts, it is functioning illegally.

Chapter 93: Section 21A. Private trade school defined; courses of instruction

Section 21A. The term “private trade school” shall, in sections twenty-one A to twenty-one G, inclusive, mean a school maintained, or classes conducted, for the purpose of teaching any trade or industrial occupation for profit or for a tuition charge but shall not include a private business school, school or college regularly chartered and authorized by the laws of the commonwealth to grant degrees, an endowed school which offers approved courses without profit, or a school exclusively engaged in training physically handicapped persons or a school conducted by any person for the education and training of his own employees.

In the licensing of new schools or the acceptance of new courses, the requirements with respect to courses of instruction in the apprenticeable skilled trades shall be determined by the board of education with the advice of the department of labor and workforce development.

The WSET falls under the definitions of a "Private Trade School"
